UGC Statement

What is UGC?

For the purposes of this document, user generated content (UGC) refers to any text, audio, image or video submitted by an individual to any Edith Cowan University digital platform, sub-domain, website, or social media account. This may include:

  • written testimonials
  • content uploaded to social media channels and tagged with an official Edith Cowan University social media handle, hashtag, or geolocation
  • responses in the comment section of a website or blog (including Google Reviews)
  • comments and posts published on an official ECU social media page

Your responsibilities when submitting UGC

Edith Cowan University does not accept responsibility for UGC on its social media accounts or websites. UGC on Edith Cowan University's social media accounts does not reflect the opinions of Edith Cowan University, and its accuracy is not confirmed by Edith Cowan University.

You are responsible for the UGC you submit. By submitting UGC, you:

  • assert and represent that you own or otherwise control or have all of the rights to the content, including intellectual property rights, privacy rights, and moral rights
  • agree to be accountable for all your actions and omissions in submitting UGC
  • agree to indemnify Edith Cowan University from and against all legal liability, actions, suits, proceedings, claims, demands, costs, and expenses that may arise or be made or taken against Edith Cowan University regarding any UGC that you submit

Contravening UGC

You must not submit UGC that Edith Cowan University determines, in its absolute discretion, is contravening UGC. Contravening UGC includes UGC that Edith Cowan University deems to be inappropriate, such as:

  • breaching Edith Cowan University Policy
  • being unlawful
  • infringing the intellectual property rights of others
  • being copyrighted, unless you are the copyright owner or have the permission of the copyright owner to post it
  • infringing the privacy or publicity rights of others
  • being obscene, violent, defamatory, misleading, threatening, harassing, abusive, profane, hateful, or embarrassing to any other person or entity
  • being sexually explicit
  • being inaccurate, false, misleading, or deceptive, or impersonating another person
  • being an advertisement or solicitation for business
  • being a chain letter, spam, or consisting of multiple off-topic posts

Edith Cowan University may delete contravening UGC or block users who submit contravening UGC without notice.

How Edith Cowan University uses UGC

If Edith Cowan University wishes to share, repost, use, publicly display, reproduce, modify, or translate your UGC, Edith Cowan University will reach out to you to obtain your written permission.

Unless otherwise agreed in your written permission, and subject to the relevant platform terms of use,:

  • your permission grants Edith Cowan University, a non-exclusive, royalty-free, worldwide, revocable, non-transferable, perpetual sub-license to use your UGC in the aforementioned ways
  • no royalties or other remuneration will be paid or payable to you for your UGC, or for the granting of the rights described above
  • Edith Cowan University will use reasonable endeavours to ensure you are given appropriate credit for your content that Edith Cowan University shares on its official social media accounts

Edith Cowan University does not claim any ownership rights to UGC.

You may choose to opt out of any agreement with Edith Cowan University regarding the use of your UGC at any time by sending an email to corporatedigital@ecu.edu.au addressed to the Digital Activation Manager.

What to do if you appear in UGC

If you identify yourself in content that has been posted on an official Edith Cowan University social media channel, and you would like it to be removed, please email corporatedigital@ecu.edu.au addressed to the Digital Activation Manager with details of the video or photo and how to identify yourself in the content. If permitted, Edith Cowan University will use its reasonable endeavours to remove the content within its control. However, if the content is UGC that Edith Cowan University obtained permission from the creator to share, Edith Cowan University has no ability to influence the visibility of the original post.
