Insights into Cyberterrorism and Law

Cyberterrorism is the use of the Internet to conduct violent acts that result in, or threaten, loss of life or significant bodily harm, in order to achieve political gains through intimidation. In recent years there has been growing concern about cyberterrorism. Any number of perpetrators can plan and execute attacks regardless of where they are located around the world, from sources including individuals, organised crime syndicates and agencies. The increase of international cyberterrorism in recent years has resulted in computer-based criminal activities that generate worldwide fear, destruction and disruption.

International laws and policies that address cyberterrorism are not cohesive in managing 21st century cyberterrorist attacks. Given the absence of an international legal framework to address cyberterrorism, authorities and governments around the world face extreme challenges in finding and prosecuting those responsible for cyberterrorism. The need for a cohesive and effective international legal framework and strengthening cross-border agreements are essential enforcement measures to address and prosecute perpetrators who plan and organise a cyberterrorist attack.

The focus of this Law Assembly is to explore and learn about cyberterrorism from an Australian perspective as well as look at the international developments. In this Assembly, the Hon. Michael Mischin MLC along with other speakers will provide their insights and discussions on this topic

This forum will feature the following presenters;

Chief Guest: Hon.  Michael Mischin MLC is the Shadow Attorney General; Shadow Minister for Commerce and Deputy Leader of the Opposition in the Legislative Council for the State of Western Australia. He was elected to the Parliament of Western Australia in September 2008, as a Liberal Party Member of the Legislative Council representing the North Metropolitan Region. He has served as the Parliamentary Secretary to the then Attorney-General and Minister for Corrective Services. He is the former Chairman of the Standing Committee on Legislation, former Deputy Chairman of Committees, former member of the Legislative Council’s Standing Committee on Uniform Legislation & Statutes Review and former member of the Standing Committee on Procedures and Privileges. A lawyer by profession, he was called to the bar in 1982, and afterward worked in a private law firm until 1985, when he joined the state government's Crown Law Department. He later worked for the Director of Public Prosecutions, reaching the rank of senior state prosecutor.

Keynote speaker: Mr Andrew Dowse is the Director of Defence Research and Engagement at Edith Cowan University. He served the Royal Australian Air Force for 37 years and was elevated to the rank of Air Vice Marshal. Prior to joining the university, he was the Head of ICT Operations and Strategic J6 with the Department of Defence. He was appointed a Member of the Order of Australia in the 2011 Australia Day Honours List in recognition of his achievements in Air Force and Capability Development Group and was then promoted to an Officer in the Order of Australia in the 2017 Queen’s Birthday Honours List in recognition of his service in capability development, strategy and planning and ICT operations.

Krishna Prasad is the Associate Dean of Law and Director International, School of Business and Law, Edith Cowan University. Prior to joining the School, he was the University’s Copyright and Legal Officer. Krishna has published, delivered and facilitated numerous presentations on cyber law and cyber terrorism both locally and internationally. In 2011, he was nominated by the Australian Government to the United Nations’ International Atomic Energy Agency to address Newly Arising Threats in Cyber Security of Nuclear Facilities. He has previously worked in private legal practice and for the West Australian Government where he was responsible for drafting the Intellectual Property Guidelines for the West Australian Tertiary and Further Education sector. In 2018, Krishna was appointed as a Justice of the Peace.
